ORDER TO SHOW CAUSE WHY THE PLAINTIFF' S CLAIM SHOULD NOT BE DISMISSED, AS MOOT

On December 22, 2006, the Court issued an Order (#260) which granted qualified immunity to the Defendants and left a single claim for trial ­that the Defendants violated the Plaintiff' right to procedural due process by denying him a meaningful opportunity to step down s at ADX. The parties have advised the Court that the Plaintiff was placed in the step-down program on January 4, 2007. They are discussing whether this renders the Plaintiff' claim moot. s Because the Plaintiff seeks only prospective relief, it appears that his claim may be moot. IT IS THEREFORE ORDERED that a hearing is set for February 28, 2007 at 4:30 p.m. in Courtroom A901 of the United States Courthouse located at 901 19th Street, Denver, Colorado. The parties shall either appear at the hearing to show cause why the Plaintiff' claim s should not be dismissed, as moot, or they may file a stipulation to dismiss the Plaintiff' claim s
