Dear Mike and Cohn: We are in receipt of Plaintifrs purported Amended Exhibit List. It is my understanding that the parties' exhibit lists are part of the April 27 Pretrial Order entered by Judge Watanabe. Consequently, we believe that any changes to the Pretrial Order must be made by the Court or by consent of the opposing party. This is the reason we requested Mike's consent to change the designations for a few of Walker Group's withesses. You will recall that he would not consent. We will be filing a motion to strike the late exhibits, and this letter is an attempt to confer pursuant to local rule. As to other trial matters, we agreed to exchange proposed jury instructions this Friday, October 7, and to discuss the instructions next Tuesday, October 11. We are not aware of any other trial matters that we should discuss prior to the Trial Preparation Conference next week. We should both take a minute to review Judge Figa's rules and the local rules to determine other items we need to discuss. CordS yours,
