The parties to the above-captioned consolidated cases, by and through their counsel of record, hereby stipulate as follows: 1. Plaintiff filed a Second Amended Complaint on November 9, 2005 in the

consolidated cases Civil Action No. 03-cv-2435-PSF-PAC and Civil Action No. 04-cv00639-PSF-PAC. See Docket Entry No. 169 in Civil Action No. 03-cv-2435-PSF-PAC. 2. The Second Amended Complaint filed November 9, 2005 identifies only

one defendant, Anthony J. Principi. 2. This amended complaint is now the only existing complaint remaining with

respect to both consolidated cases, i.e., Civil Action No. 03-cv-2435-PSF-PAC and Civil Action No. 04-cv-00639-PSF-PAC. 4. No other complaint or amended complaint is now at issue in either of the

above-captioned consolidated cases, nor is any other defendant other than defendant Anthony J. Principi a defendant in either case. 5. The parties note that Civil Action No. 04-cv-00639-PSF-PAC identifies

several other defendants besides Anthony J. Principi, namely, Ed Sanchez, Raymond Deluna, and E. Thorsland, Jr. 6. Because Ed Sanchez, Raymond Deluna, and E. Thorsland, Jr. are not

identified as defendants in the Second Amended Complaint filed November 9, 2005, they should be dismissed from this action. 7. The Second Amended Complaint filed November 9, 2005, does not address

any of the facts or circumstances underlying Civil Action No. 04-cv-00639-PSF-PAC. 8. Because the Second Amended Complaint filed November 9, 2005, does not

address any of the facts or circumstances underlying Civil Action No. 04-cv-00639-PSFPAC, Civil Action No. 04-cv-00639-PSF-PAC should be dismissed. 9. These two cases should no longer be consolidated. Rather, the caption of

this consolidated matter should be amended. Civil Action No. 03-cv-2435-PSF-PAC should be the only case number listed in the caption, and Lillian F. Sandle and Anthony J. Principi should be the only plaintiff and defendant listed, respectively, in the caption.
