This matter is before the Court on Defendant' Motion for Extension of Time to s File Response to Plaintiff' Motion for Partial Summary Judgment (Dkt. # 261) and s Defendant' Unopposed Motion for Leave to File Motion for Summary Judgment Re s Counter-Claim One Minute Late (Dkt. # 262). It is hereby ORDERED that these motions are GRANTED. Defendant shall have to and including September 29, 2006 within which to file a response to plaintiff' motion for partial summary judgment. The s Court also will allow defendant the filing of its motion for summary judgment regarding its counter-claim one minute late, i.e. at midnight on September 2, 2006.
