STIPULATION FOR WITHDRAWAL OF JURY DEMAND ________________________________________________________________________ The parties, through their undersigned counsel, submit the following stipulation pursuant to Fed. R. Civ. P. 38(d) concerning plaintiff's demand for a jury trial. Plaintiff withdraws her jury demand in recognition of the fact that the claims at issue in this action pre-date the effective date of the Civil Rights Act of 1991 (November 25, 1991), Pub. L. 102-166, 105 Stat. 1072 (codified at 42 U.S.C. § 1981a(a)), which waived the United States government's sovereign immunity to provide for a jury trial in actions filed pursuant to the Civil Rights Act of 1964 and the Vocational Rehabilitation Act of 1973, 29 U.S.C. § 791. The defendant agrees that no jury trial is permissible as to any claim at issue in this action. With respect to defendant's counterclaim for unjust enrichment, defendant

acknowledges that it has no right to a jury trial. An unjust enrichment claim is an equitable claim that does not entitle a party to a jury trial. Roberts v. Sears, Roebuck & Co., 617 F.2d 460, 465 (7th Cir.), cert. denied, 449 U.S. 975 (1980); Security and Exchange Commission v. Commonwealth Chemical Securities, Inc., 574 F.2d 90, 95-96 (2d Cir. 1978); Emmpressa Cubana Del Tabaco v. Culbro Corp., 123 F. Supp 2d 203, 206 (S.D.N.Y. 2000); Metal Processing Co., Inc. v.
