HEARING: Final Trial Preparation Conference 8:32 a.m. Court in session.

Plaintiff Camille Melonakis-Kurz present in the courtroom, defendant representative, Darren Beck, present by telephone. Discussion regarding non-compliance with final trial preparation order. Discussion regarding Motion to Decertify (Doc. #338). Oral findings and conclusions of law are made of record and incorporated herein. ORDER: Stipulated Motion to Continue Trial and Final Pretrial Conference (Doc. #334) is granted. The trial date of May 22, 2006 is VACATED. The parties shall file a joint request for an evidentiary hearing on the motion for decertification by February 17, 2006. The parties shall advise the Court as to where the factual disputes are, as to what issues, and how long they are going to need for an evidentiary hearing.

The Court will tentatively set a hearing on the motion for decertification on Thursday, May 11, 2006 at 1:30 p.m., continuing to Friday, May 12, 2006 in courtroom A901, 901 19th Street, Denver, Colorado.

The Court addresses the parties. The Court advises the parties to set up a settlement conference with Magistrate Judge Patricia A. Coan. 8:52 a.m. Court in recess.
