Discussion is held regarding pending motions. Mr. Hale advises the Court the Hale Friesen firm will not be calling any representative from their firm under any set of circumstances to testify for any reason. It is ORDERED: Plaintiff' MOTION TO WITHDRAW Robert Bruce (Docket No. 63, s Filed August 09, 2005) is GRANTED for reasons as stated on the record. Mr. Robert J. Bruce is relieved of any further representation of Plaintiffs in this matter. Defendant Boyces' MOTION TO AMEND SCHEDULING ORDER (Docket No. 70, Filed August 17, 2005) is GRANTED for reasons as stated on the record. The Scheduling order is amended for the limited purpose of allowing the deposition of PETER HORNICK which shall go forward. The deposition must be taken and completed no later than SEPTEMBER 21, 2005.

Defendants request that the Dispositive Motions deadline be extended to a date after the deposition of Mr. Hornick. Following discussion, the request is deemed withdrawn and it is determined that no new dispositive motions deadline needs to be set.
