ORDER DENYING MOTION FOR STAY OF PROCEEDINGS

This matter comes before the Court on Plaintiff' Motion for a Stay of s Proceedings Pending Appeal (Dkt. # 197), filed October 18, 2005. On October 25, 2005, the Tenth Circuit Court of Appeals dismissed plaintiff' appeal for lack of s appellate jurisdiction (Dkt. # 199).
