(collectively, "Presby") submit this Status Report pursuant to this Court's minute order dated June 28, 2005 (the "Order"). 1 The Order was entered in connection with the Parties' June 27, 2005 Joint Status Report and Motion for Stay Pending Final Ruling from the U.S. Patent Office (the "Motion"). Since the time of the Motion, the U.S. Patent Office granted Dr. Howard N. Straub's application for a patent on the "Restorvision Implant" (the "Patent Application") (as defined in the Motion), but later granted the Plaintiffs' Request for Reexamination. As such, the Patent Application is once again pending before the U.S. Patent Office and the subject of a Patent Office rejection on substantive grounds.

1 This suit has been administratively closed. Although the Order does not specifically require a status report at this time, the Court has requested updates in the past. Therefore, Presby offers this status report simply for informational purposes.
