Bornstein and Thomas J. Hammond, and moves to join co-defendant's motions to dismiss the Second Superceding Indictment. In support of this motion, Mr. Schmidt states the following: 1. Mr. Schmidt has filed a separate Motion to Dismiss Second Superceding

Indictment and a Supplement to Motion to Dismiss Second Superceding Indictment. 2. Defendant Jannice McClain Schmidt filed a Motion to Dismiss Counts 1, 3-

9, 16, 17, and 20-29 of Second Superceding Indictment on December 30, 2005. 3. Defendant Charles Lewis filed a Motion to Dismiss Counts 1, 7, 8, and 9 of

Second Superceding Indictment on December 30, 2005. 4. The issues raised by Defendants Lewis and McClain Schmidt also are

relevant in Mr. Schmidt's case. Joinder will allow the issues to be heard efficiently and without unnecessary duplication of separate pleadings. 1
