GEORGE ALAN WEED Defendant. ______________________________________________________________________________ MOTION FOR ORDER DIRECTING UNITED STATES MARSHAL TO ARRANGE NON-CUSTODIAL TRANSPORTATION ______________________________________________________________________________ Defendant George Alan Weed, through counsel, moves, pursuant to 18 U.S.C. § 4285, for an order directing the United States Marshal to arrange for his non-custodial transportation from the airport in Marion, Illinois to Denver for purposes of: a) attending the 2 March 2007 1:30 p.m. first trial preparation conference before this Court; and b) attending the 30 March 2007 1:30 p.m. second trial preparation conference before this Court, and then, the ensuing trial of this matter, which commences three days later, on 2 April 2007. Mr. Weed further requests pursuant to 18 U.S.C. § 4285 that the Court order the Marshal to furnish Weed with an amount of money for subsistence expenses to Denver "not to exceed the amount authorized as a per diem allowance for travel under section 5702(a) of title 5, United States Code."

In support of this Motion, Defendant Weed notes the following. He has qualified for the appointment of CJA counsel in this case. As reflected in the attached financial affidavit, Mr. Weed's financial resources are meager, indeed. He is financially unable to pay for the round trip air fares to be present at the upcoming pretrial conferences and trial. Mr. Weed resides in Benton, Illinois. The closest airport to Benton is the one in Marion, Illinois. However, Mr. Weed hereby advises the Court that he also could drive to St. Louis to catch an airplane if that would result in a cost savings. For the reasons stated above, Mr. Weed respectfully requests that this Motion be granted. Dated this 21st day of February, 2007. Respectfully submitted,
