Defendant. ______________________________________________________________________________ MOTION TO EXCUSE DEFENDANT'S APPEARANCE AT STATUS CONFERENCE ______________________________________________________________________________ Defendant George Allan Weed, through counsel, requests that his appearance be waived for the forthcoming status conference. That conference is scheduled before this Court on 3 February 2006 at 1:30 p.m. Said conference is the type of proceeding for which a defendant's appearance may be waived under Federal Rule of Criminal Procedure 43(b)(3). As the Court is well aware, Mr. Weed previously has met the indigence standard necessary to qualify for CJA appointed counsel. He resides in Illinois. Compelling Mr. Weed to attend the hearing would impose a financial hardship on him. This Court has previously excused Mr. Weed from attending other status conferences in this case. WHEREFORE, Defendant Weed respectfully requests that this Motion be granted.
