GOVERNMENT'S MOTION TO DISMISS THE ORIGINAL INDICTMENT, FIRST SUPERSEDING INDICTMENT, & SECOND SUPERSEDING INDICTMENT

The United States, by and through Matthew T. Kirsch, Assistant United States Attorney for the District of Colorado, hereby moves the Court for an Order dismissing the original Indictment [Doc. # 1], the First Superseding Indictment [Doc. # 153], and the Second Superseding Indictment [Doc. # 526] returned against the defendant. This motion is based on the defendant's guilty plea to Counts 1 and 2 of the Superseding Information pursuant to a plea agreement. THEREFORE, the government requests that the original Indictment, the First Superseding Indictment, and the Second Superseding Indictment be dismissed as they pertain to defendant Jannice Schmidt.
