Michael Smith, Defendant. ______________________________________________________________________ ________ WITHDRAWAL OF MOTION FOR INDIGENT DEFENDANT TRAVEL AND LODGING _____________________________________________________________________ Defendant Michael Smith, through his attorney Richard N. Stuckey, respectfully withdraws his Motion for Indigent Travel and Lodging (Doc. No. 995) for the following reasons: 1. Defendant Michael Smith plans to drive to Denver for the trial in this case by private vehicle so that he will have access to that vehicle during the trial. 2. After viewing the statute, and the requirements for lodging payments, Defendant Smith has made plans to stay in Denver during the trial with friends. 3. The United States Magistrate Judge ordered (Doc. No. 1010) that Defendant Smith reply by February 28, 2007, to the Government's Response to Defendant's Motion for Indigent Travel and Lodging payments, and this withdrawal will serve, it is respectfully requested, as that reply. WHEREFORE it is respectfully requested that this Court allow Defendant Smith to withdraw his request for travel and lodging.
