Stuckey, appointed by the Court for Defendant Michael Smith, respectfully requests that the Court approve the withdrawal by the defense of the subpoena served on AUSA James Russell. The government has filed a motion to quash the subpoena, and the Court has ordered a response by May 7, 2007. However, as announced in Court by the undersigned on April 26, 2007, the defense for Michael Smith has decided not to call AUSA Russell in this case, and has informed the government that the subpoena is withdrawn.
