· Defendants failure to produce a 30(b)(6) witness concerning their alleged unfair
competition claims
• The exclusion of Patricia Sweeney's expert report
• The '84O patent is no longer relevant to the case at bar
• Prank Tenbarge's second expert report should be excluded
• The exclusion of alleged prior art samples from the '80s

• Plaintiffs failure to produce promised list of available seed samples
• Plaintiffs failure to produce any seed samples
