ORDER GRANTING DEFENDANT'S MOTION FOR CREDITS

THIS MATTER, comes to the Court for an Order requiring certain credits to be applied against any judgment which may be entered against Defendant in favor of Plaintiff in this matter. THE COURT, being fully advised in these premises, finds that the Union Pacific made advance payments to Plaintiff in the total amount of $7,965.00 and the Railroad Retirement Board paid the Plaintiff $5,321.14 in Railroad Retirement Benefits. The Court further finds and orders that the total amount of $13,286.14 shall be deducted from any verdict recovered by Plaintiff to cover these payments previously made to Plaintiff. THE COURT NOW ORDERS that the total sum of $13,286.14 shall be credited against the amount of any judgment entered in favor of Plaintiff and against Defendant in this matter.
