COAN IT IS HEREBY ORDERED that plaintiff' tendered pro se prisoner civil rights s complaint, received on June 16, 2006, is REJECTED. This action was dismissed with prejudice on March 30, 2005. On appeal, the Tenth Circuit affirmed the dismissal, but held that the claims dismissed for failure to exhaust administrative remedies were dismissed without prejudice. See Order and Judgement in Young v. United States, Case No. 05-1120, filed August 25, 2005, at 4-5. Plaintiff must initiate a new civil action. Plaintiff can file his complaint and pay the $350.00 filing fee, or tender his complaint to the court along with a Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. ยง1915.
