The Court declines to rule on whether or not the deposition that will be taken tomorrow will be admissible in lieu of live evidence. The order granting the motion in part will allow for an one hour deposition to be divided equally between the parties to begin at 2:00 p.m. tomorrow on August 9, 2005. The motions hearing set for Thursday, August 11, 2005 at 4:30 p.m. is VACATED.
