DEFENDANT'S MOTION FOR SUMMARY JUDGMENT

Pursuant to Fed. R. Civ. P. 56, Defendant Omni Properties, Inc. ("Omni"), respectfully submits its motion for summary judgment against Plaintiff Joseph Steinbach, Jr. ("Plaintiff"), on his sole claim for relief, which alleges retaliation under the Americans with Disabilities Act ("ADA"). This Motion is based upon the accompanying Brief in Support of Defendant's Motion for Summary Judgment, incorporated by reference herein. WHEREFORE, Omni respectfully requests that this Court: 1. Enter judgment against Plaintiff and in favor of Omni on Plaintiff's sole claim for retaliation under the ADA; and Award Omni such other and further relief as the Court deems just and proper, including but not limited to an award of Omni's attorneys' fees and costs.
