UNOPPOSED MOTION TO RE-SET SETTLEMENT CONFERENCE ______________________________________________________________________________ Defendant, KARL SCHERCK, by his attorneys, THOMAS S. RICE and GILLIAN M. FAHLSING of the law firm SENTER GOLDFARB & RICE, L.L.C., hereby moves this Court for an Order re-setting the Settlement Conference currently scheduled for June 1, 2006. IN SUPPORT THEREOF, Defendant states as follows: 1. Pursuant to D.C.COLO.LCivR 7.1(A), undersigned counsel conferred with

counsel for Plaintiff, Mr. William Meyer, on April 27, 2006. Mr. Meyer states that Plaintiff will not object to the relief requested herein. 2. At the Final Pretrial Conference in this matter, the Court set a Settlement

Conference for June 1, 2006 at 10:30 a.m. [Doc. # 63.] Undersigned counsel has learned that the Assistant City Attorney for the City of Westminster is unavailable to attend the Settlement Conference at that time. The City of Westminster employed Defendant at the time of the incident and, accordingly, desires to be present at the Settlement Conference.

The Court has advised that it can conduct a Settlement Conference on June 15,

2006 at 3:00 p.m. Plaintiff' counsel has represented that he and Plaintiff are available on June s 15, 2006 to conduct the Settlement Conference. Defendant' counsel is also available on this s date and has confirmed with the Assistant City Attorney, the Defendant, and a representative with settlement authority, that each of these persons is available on June 15, 2006. WHEREFORE, Defendant respectfully requests that the Court re-set the currently scheduled June 1, 2006 Settlement Conference to June 15, 2006 at 3:00 p.m. Respectfully submitted,
