STATUS REPORT

Defendants, except John Doe, by and through their attorneys, Nathan, Bremer, Dumm & Myers, P.C., pursuant to the Federal Rules of Civil Procedure, hereby provide the following status report. As the Court is aware, during the discovery process the parties engaged in settlement

discussions. Prior to completing discovery the parties tentatively reached a settlement agreement and therefore canceled the remaining depositions. 2. To date, the parties have agreed on almost all of terms of the settlement and are in the

process of finalizing the Release and Settlement Agreement and necessary pleadings. The parties have one remaining issue regarding the settlement which needs to be resolved, and which hopefully should be resolved in the near future. 3. According to the Court Order dated June 22, 2005, the discovery cut off in this case is

currently August 12, 2005. Unfortunately, the parties will be unable to finalize the settlement by this date. 4. While the parties do not foresee any reason why the settlement would not be finalized in

the near future, the parties wanted the Court to be aware of the status of the settlement and the fact that despite the discovery cut off date, the parties have not completed discovery. Respectfully submitted, NATHAN, BREMER, DUMM & MYERS, P.C.
