QWEST COMMUNICATIONS INTERNATIONAL INC., et al., Defendants. UNOPPOSED MOTION TO MODIFY THE BRIEFING SCHEDULE RELATING TO THE MOTION BY THE DEFENDANTS QWEST COMMUNICATIONS INTERNATIONAL, INC. AND QWEST CAPITAL FUNDING, INC. TO DISMISS THE COMPLAINT IN CIVIL ACTION 06-CV-02189.

Plaintiff hereby moves this Court for modification of the Briefing Schedule heretofore set by this Court, with the consent of the Moving Parties, and good cause having been shown, as follows: 1. Plaintiff's answering papers with respect to the Moving Defendants' Motion to Dismiss the Complaint in Civil Action 06CV02189, now due on February 14, 2007, shall now be due on March 16, 2007. 2. Moving Defendants' reply papers, now due on March 16, 2007, shall be due on April 15, 2007. The grounds for this application are as follows:

On January 15, 2007, the Moving Defendants, pursuant to a prior agreement between the parties, served their Motion to Dismiss the Complaint in Civil Action 06-CV-02189. Pursuant to the Briefing Schedule previously agreed by the parties and approved by this Court, Plaintiff's Answering Papers were due on February 14, 2007, and the Moving Defendants' Reply Papers were due on March 16, 2007. Through no fault of the Moving Defendants the said Motion Papers were received late by the I. Walton Bader, Esq., and a cursory reading of the Moving Defendants' Papers indicated substantial legal issues that must be addressed by the parties and which will require more research time than was originally believed. In addition I. Walton Bader, Esq. was confronted with serious family problems which were required to be addressed immediately which also required substantial expenditure of time on the part of I. Walton Bader, Esq. By reason thereof I. Walton Bader, Esq. contacted counsel for the Moving Defendants and obtained their consent for the time extension sought. Accordingly this application is made prior to the time when Plaintiff's Answer Papers would be due as provided in Rule 6(b) of the Federal Rules of Civil Procedure. The Plaintiff therefore respectfully submits that this motion be granted. An appropriate Order is also being submitted pertaining to this Motion.
