Argument and discussion regarding Plaintiff' Third Motion for Order to Compel s Defendants' Disclosure [Doc. #102, filed 8/26/05] ORDERED: The Court finds that Plaintiff' Third Motion for Order to Compel s Defendants' Disclosure [Doc. #102, filed 8/26/05] is not in proper form pursuant to Local Rule 37.1, which the Court reads to Plaintiff; that Plaintiff did not confer with Defendants' counsel; that Defendants' counsel states he has provided most of the documents requested by Plaintiff; and that this is the third time Plaintiff has filed the same motion. For those reasons stated, the Plaintiff' Third Motion for Order to Compel s Defendants' Disclosure [Doc. #102, filed 8/26/05] is DENIED. Mr. Pestal orally moves for an extension of time to file Defendants' reply to the Motion for Summary Judgment. Plaintiff has no objection to the extension. ORDERED: Defendants' oral motion for an extension of time to file a reply to the Motion for Summary Judgment [Doc. #110, filed 9/16/05] is GRANTED to and including October 26, 2005.
