Wesoky, hereby move the Court for an order permitting Mr. Wesoky to individually withdraw as counsel of record for the City, and in support of this Motion, state the following: 1. Assistant City Attorney Christopher M.A. Lujan who has entered his

appearance in this case on behalf of the City will continue his representation of the City in the remaining stages of this case. 2. Additionally, the City has retained outside counsel, Richard Barkley of the

law firm of Brownstein, Hyatt and Farber, who will be entering his appearance on behalf of the City. . 3. Permitting the withdrawal of Mr. Wesoky will not in disrupt or delay any

proceedings in this case in light of the fact that Assistant City Attorney Lujan and outside counsel will continue to represent the City in the remaining stages of this case.

Mr. Wesoky has obligations in other matters that require his attention and

necessitate this motion. 4. Good cause exists for an order permitting Mr. Wesoky to individually

withdraw as counsel for the Defendant. See D.C.COLO.LCivR 83.3 D (permitting withdrawal on a motion showing good cause). 5. In compliance with D.C.COLO.LCivR 7.1 A, the Plaintiff's counsel has

been contacted concerning this Motion and advises that the Plaintiff does not oppose this motion. WHEREFORE, Jack M.
