FINDINGS Congress finds that two previous United States Forest Service Environmental Assessments have been conducted,with both subject to full public review and comment regarding The Village at Wolf Creek land trade and the Wolf Creek Ski Area facilities expansion and the subject access corridor and road. The Preferred Alternatives approved the Village and the selected access corridor for The Village at Wolf Creek. Further, a multitude of environmental studies have been conducted on The Village at Wolf Creek and the access corridor, without negative environmental findings and with positive findings of economic, tourism, and financial impact. Congress hereby declares The Village at Wolf Creek at =Pilot Energy Efficiency Project" with the goal of building the entire Village of 2172 units, the utility and transportation systems and all energy resources with the goal of saving 50-70% of the energy that would be consumed if, built conventionally, and with express goal of the project providing invaluable technology implementation with applicability to other communities throughout the nation. AUTHORIZATION The Secretary of Agriculture is authorized and directed, within thirty days to: a: convey a permanent road and transit easement for public way in the Rio Grande Forest to The Village at Wolf Creek Property Owners Association located in Mineral County, Colorado, 60 feet in width and approximately 2100 feet in length extending from Colorado State Highway 160 to The Village at Wolf Creek boundary and road entrance as platted in the Mineral County Preliminary PUD Resolution No. 00-13, dated August 24, 2000, with final alignment as approved by U. S. Forest Service for the Ski Area Expansion Road; convey a ten-foot non-exclusive easement for underground power and cables which shall be located within such right of way for the benefit of the San Luis Valley Rural Electric Cooperative, Inc., with final alignment to be approved by Mineral County; convey a second ten-foot non-exclusive easement for underground telephone, cable, fiber optic, and other utilities, utility lines, and associated facilities to be WC 01901

located within such road right of way for the benefit of The Village at Wolf Creek Property Owners Association with final alignment to be approved by Mineral ·County for the benefit of The Village at Wolf Creek; d: vacate and abandon FS 391 from SH 160 to the eastern boundary of the 'v'iilage property and vacate and abandon that certain easement for access by the general public to Alberta Lake, as granted on May 14, 1987, upon the construction, acceptance of the condition of the constructed roadway, and grant of right away easement, twenty feet in width; to the U.S. Forest Service approximately along the alignment set forth above for the 2100-foot access road on and continuing through The Village at Wolf Creek property, approximately as shown on Exhibit A and Exhibit B, and across the private land, approximately as shown on Exhibit A, to be approved by final Mineral County plat. Such easement will also include underground utility installation and with such road maintained in perpetuity by The Village at Wolf Creek Property Owners Association; amend that certain U.S. Forest Service Electric Service Easement granted to the San Luis Rural Electric Cooperative dated April 28, 2000 (Holder No. 4032.16, Type Site B 121 Authority 676), to remove the exclusive service to the Alberta Ski Lift provision so that other uses for the electrical power by the Wolf Creek Ski Corporation may be served by the easement; convey a permanent easement to The Village at Wolf Creek Property Owners Association, such easement to be approximately four and one-half miles long and 100 feet in width for a natural gas line. access, and other utilities in the San Juan and Rio Grande Forests to The Village at Wolf Creek boundary, approximately as shown on Exhibit C.
