The matter is set for Jury Trial on July 7, 2008 at 9:00 a.m. in Durango, Colorado and is anticipated to last for 2 weeks. The Final Trial Preparation Conference date will be set by Judge Kane and is anticipated to be in mid-May of 2008. As to the briefing schedule for Defendant's pending Motion for Bifurcation, the Plaintiff and Defendant have included their legal arguments in their motion and response. The Defendants shall have until February 15, 2008 to file a Reply to Plaintiff's Response. Motions in Limine, Objections to Exhibits and Objections to Deposition Designations must be filed no later than March 14, 2008. Daubert motions must be filed by February 20, 2008.

A discussion regarding non-binding mediation was held and a Scheduling Conference with the Magistrate Judge in Durango, Colorado is scheduled for January 25, 2008 at 2:30 p.m. A copy of the Jury Instructions and Verdict Forms were delivered to Judge Kane's office in Denver, Colorado on Friday, January 18, 2008, but as of this hearing, have not been filed. Objections to the Jury Instructions and Verdict Forms must be submitted by March 15, 2008 and will be argued at the Final Trial Preparation Conference in mid-May. The Pretrial Order is finalized and will be filed with the Court on this date. Court in Recess: 9:28 p.m. Hearing Concluded Time: 28 Minutes
