MEER ______________________________________________________________________________ Defendant, Leavell-McCombs Joint Venture, d/b/a The Village at Wolf Creek ("the Joint Venture"), through its undersigned counsel, respectfully submits this Response to Plaintiff Wolf Creek Ski Corporation's Daubert Motion to Exclude the Testimony and Report of Defendant's Expert Lisa A. Meer. Upon conferral with opposing counsel, the Joint Venture understands that Plaintiff is willing to withdraw its motion under stipulation that Ms. Meer will only testify as to certain limited matters. Accordingly, the Joint Venture hereby stipulates as follows: (1) Ms. Meer will not opine on causation; (2) Ms. Meer will not opine on future damages; (3) the Joint Venture will not be calling the underlying `experts' referenced in Ms. Meer's expert report (other than John Montgomery who is a separate expert and the subject of a separate Daubert motion) to offer

opinion evidence; and (4) Ms. Meer will offer testimony only in her capacity as a CPA as to actual costs expended by the Joint Venture and will not to testify as to reasonableness of same.
