IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLORADO Civil Action No. O4-cv-01124-JLK-MEH LINDA FORGACS, MONICA JONES, DANIEL LINK, GRACE MORENO AND PAM ROGGE, Plaintiffs, V. EYE CARE CENTER OF NORTHERN COLORADO; WILLIAM L. BENEDICT, M.D.; JOEL S. MEYERS, M.D.; MORRIS TILDEN, M.D.; IRENE OLIJNYK, M.D.; and JAY R. HOLMS, Defendants. _____________________________________________________________________ STATUS REPORT _____________________________________________________________________ Come now the parties, by and through their respective counsel and hereby submit this status report pursuant to this Court's Order of July 18, 2006. Plaintiffs Jones, Link, Moreno and Rogge reached agreements with the Defendants in this matter about settling and dismissing those Plaintiffs' claims. The parties, however, do not agree about whether their settlement included a release of Defendants' claims for attorney fees and costs against Plaintiffs' attorney under Rule 11, 28 U.S.C. § 1927 and C.R.S. § 13-17-102. The matters related to Plaintiff Forgacs remain unresolved, and counsel for the Plaintiffs has suggested to Magistrate Judge Michael Hegarty that another settlement conference be held. Counsel for the Defendants agrees that this is a sensible approach. Counsel for the parties believe that a further settlement conference may resolve the remaining issue in the Jones, Link, Moreno and Rogge matters. 1
