_____________________________________________________________________ COURTROOM MINUTES _____________________________________________________________________ HEARING: FINAL TRIAL PREPARATION CONFERENCE 3: 30 p.m. Court in session. Court calls case. Appearance of counsel. Plaintiff, Ms. Towers, is also present. Plaintiff, Defendant and Stipulated Proposed Jury Instructions and Verdict Forms are received by the Court. Plaintiff' voir dire questions are provided; Defense counsel s shall tender proposed voir dire questions to the Court no later than November 09, 2005. As no technical terminology is anticipated, no Terminology List is provided. The Court alerts counsel that an older case is also set for Trial to begin November 14, 2005. Plaintiff requests this case remain on the trailing docket; Defendant requests the Court set a date certain for this case to proceed to trial. The Court will keep counsel apprised of the status of the other case and render its decision by November 10 as to when this case will proceed to trial. This case will be tried within sixty to ninety days.

Therefore, this Trial Date currently remains set November 14, 2005. Counsel shall confer and attempt to stipulate to more facts and counsel shall make any objections to deposition testimony on or before November 09, 2005. Plaintiff shall submit her " back pay Jury Instruction"on or before November 09, 2005. A JOINT WITNESS LIST shall be submitted no later than NOVEMBER 09, 2005. A JOINT EXHIBIT LIST shall be submitted no later than NOVEMBER 09, 2005. In consideration of the software utilized by counsel, the court will allow the submission of exhibits with Exhibit Labels with or without the case number on each label. Each side shall have fifteen minutes for lawyer voir dire. Each side shall have three peremptory challenges. The trial shall be heard by a Jury of ten, with no alternates. ORDER: Plaintiff' Oral Motion for Sequestration is GRANTED. Therefore, all s witnesses with the exception of the Plaintiff and/or Client Representative(s) seated at counsel table shall be sequestered.
Counsel request that the Court discuss setting a settlement conference with a Magistrate Judge within the next week. 4:20 p.m. Court in recess.
