Respondents wish to alert the Court that the Colorado Court of Appeals issued an opinion in People v. Cappelli, No. 04CA1682 (Colo. App. Oct. 5, 2006) (not selected for publication), which relates to the state court convictions being challenged in this 28 U.S.C. § 2254 proceeding. The opinion affirms the trial court's August 16, 2004 order denying Cappelli's state postconviction motion, which was filed in the trial court on June 15, 2004. A copy of the opinion is being filed as Exhibit A.
