HEARING: Final Trial Preparation Conference 4:01 p.m. Court in session.

Plaintiff Mr. Richard Tebo present in the courtroom by telephone and defendant representative, Ms. Darcy Levtzow, present in the courtroom. Discussion regarding remaining claim in the case and time needed for trial. Discussion regarding witness and exhibit lists. ORDER: A revised joint witness list shall be submitted by May 1, 2006.

Oral findings and conclusions of law are made of record and incorporated herein. ORDER: Motion in Limine (Doc. #73) is denied. As to the relevance objection, it is denied with leave to renew.

Discussion regarding voir dire. Defendants request a sequestration order.

Defendants' request for a sequestration order is granted. All witnesses shall be sequestered.

The parties shall have 15 minutes for opening statements and 30 minutes for closing arguments. Admitted exhibits, jury instructions, and the verdict form may be used in closing arguments. Demonstrative aides my be used in closing arguments by agreement of the parties. No exhibits or demonstrative aides may be used in opening statements. 4:37 p.m. Court in recess.
