Defendant TIC ­ The Industrial Company ("TIC"), by and through its undersigned counsel, hereby files this Substitution of Affidavit of Donald L. Hotaling and in support therefore states as follows: 1. On May 3, 2006, TIC filed its Reply Memorandum in Support of Motion for Summary Judgment ("Reply Brief"). Attached as Exhibit A-26 to TIC's Reply Brief is the Affidavit of Donald L. Hotaling. 2. TIC's counsel inadvertently failed to attach the exhibits to Donald L. Hotaling's affidavit. Accordingly, TIC hereby substitutes the attached Affidavit of Donald L. Hotaling (with exhibits) for the Affidavit of Donald L. Hotaling submitted as Exhibit A-26 to the Reply Brief.
