Montoya, by and through his counsel, Hall & Evans, L.L.C., and Awilda R. Marquez, hereby corrects an assertion made in his Motion for Reconsideration of Magistrate Judge's Order Denying Leave to Depose Plaintiff ("Motion"). In his Motion, Defendant Montoya stated, "[t]he parties have already exchanged initial disclosures." The assertion, however, was an inadvertent error. No initial disclosures have been made in this case. This action is exempt from the requirement of initial disclosures pursuant to Fed. R. Civ. P. 26(a)(1)(E)(iii). Defendant Montoya apologizes for the inadvertently incorrect statement made in his Motion for Reconsideration.
