Defendants, Mayor Ed Tauer, Aurora Police Chief, Sergeant Graham, and Officers Hirtle, Zius and Sloan, by their attorney, Julia A. Bannon, and pursuant to F.R.C.P. Rule 56, hereby submit their Motion for Summary Judgment and as grounds therefore state as follows: 1. Plaintiff's claims against the City of Aurora, Mayor Ed Tauer, and Aurora Police

Chief are barred because Plaintiff cannot establish that Aurora Police Department officers violated a constitutional or statutory right and by the holding of Monell v. Department of Social Services, 436 U.S. 658, 691 (1978), in that Plaintiff cannot establish a custom or policy of illegal searches within the Aurora Police Department.

Plaintiff's claims against the individual officers in their individual capacities are

barred by the doctrine of qualified immunity.
