The Defendants hereby move the Court for an Order reopening the evidence in this case and admitting the two attached documents as Exhibits 616 and 617. As grounds, the Defendants state as follows: 1. At the end of the trial, undersigned counsel indicated that the Defendants

might seek to reopen the evidence to admit the Fourmile Creek Springs Permit and its Rationale because they had just learned that those documents were expected to issue from the State that very afternoon. 2. The Court reminded counsel to confer before doing so. Pursuant to that

reminder, and D.C.COLO.LCivR 7.1(A), counsel has done so. Counsel for the Plaintiffs has indicated they do not oppose this motion or the admission of Exhibits 616 and 617 if they are not offered for their truth. The Defendants agree they are not offering those exhibits for their truth.1 3. There is no opposition to the Court exercising its discretion to reopen the

evidence and admit Exhibits 616 and 617 (but not for the truth of matters set forth therein). See United States v. Larson, 596 F.2d 759, 778 (8th Cir. 1978). Because there is no opposition, no evidentiary objection, no prejudice, and there was no way to present these exhibits during Defendants' case-in-chief because they did not yet exist, the Court should reopen the evidence and admit Exhibits 616 and 617 (but not for their truth).

They also note that the Fourmile Creek Permit (Exhibit 617) becomes effective on April 1, 2006, as noted. The Defendants do not intend to appeal or in any way challenge that Permit and are willing to provide a status report to the Court after April 1, 2006 confirming that if the Court wishes. 2
