The court upon its own motion consolidates, for procedural purposes only, the captioned appeals. Counsel are advised that both appeal numbers must appear on all pleadings, motions, and briefs filed in the court. On March 19, 2008, an order was entered in No. 07-1466 dismissing that part of the appeal pertaining to Proposed Intervenors Matthias Hobza and Roy McIntosh based on lack of appellate jurisdiction. Upon consideration, Plaintiff Ricky Clark's and Proposed Intervenors Hobza and McIntosh's "motion for consolidation" is DENIED. And, Plaintiff Clark's and Proposed Intervenors Hobza and McIntosh's "motion to extend deadline for payment of docket fee re

appeal #07-1466" and motion "to apply docket fee paid in appeal #07-1454 to consolidated appeals #07-1454 and 07-1466" are DENIED. The filing fees for No. 07-1466 must be paid within 10 calendar days of the date on this order. Upon further consideration, briefing on the merits may proceed. The opening brief and appendix in the captioned appeals for Appellant-Plaintiff Clark must be served and filed 40 days after the date on this order. The answer brief for Appellee-Defendant State Farm Mutual Automobile Insurance Company must be served and filed 30 days after service of the opening brief. Appellant-Plaintiff may serve and file a reply brief 14 days after service of the answer brief. See 10th Cir. R. 31.4 and 31.5.
