Beans, Jr. ("Defendants"), by and through their attorneys, O'Melveny & Myers LLP, seek permission to submit the attached reply in further support of their motion to compel discovery pursuant to Fed. R. Civ. P. 37(a). 1. On August 10, 2005, Defendants moved for an order compelling Plaintiffs

to provide certain discovery. 2. motion. 3. 4. The Court set the hearing on Defendants' motion for September 6, 2005. Plaintiffs' Opposition mischaracterizes Defendants' position on a number On August 30, Plaintiffs submitted a response opposing Defendants'

of the disputed requests as well as the applicable authorities. Defendants seek to submit a brief reply in order to correct the record in advance of the hearing, thereby crystallizing the areas of actual dispute. Accordingly, there is good cause to grant Defendants' motion to submit a reply.
