Counsel for Plaintiff has filed over twenty Joint Motions to Continue Administrative Closure

in related cases, and inadvertently filed one in this case.

This particular case, however, has been appealed to the United States Court of Appeals for the

Tenth Circuit, and was never subject to the administrative closure referenced in the Joint Motion to Continue Administrative Closure. 3. Plaintiff requests that the Joint Motion to Continue Administrative Closure be stricken from

this case. 4. A proposed order is attached.

Request for Relief: Wherefore, Plaintiff respectfully requests that the Joint Motion to Continue Administrative Closure filed 27 July 2005, be stricken from this case.
