Negotiations followed, pertaining to the form and content of a written settlement In mid-July 2007, the parties reached a tentative agreement to settle all claims in

agreement, including distribution of settlement payment. In late August 2007, a final agreement was reached and submitted for signature by the responsible participants. 3. The agreement was circulated for signature and the necessary signatures were

obtained, but for that of the State Controller, who must be the final signatory on any such agreement. The documents are now with the State Controller for final authorization and

completion of the arrangement. In light of such facts, it is now anticipated that a Joint Motion to Dismiss with Prejudice will be filed within the next two weeks.
