GOVERNMENT'S MOTION FOR LEAVE TO SUBMIT OUT-OF-TIME PROPOSED TELEPHONE CALLS
The United States of America, by and through the undersigned Assistant United States Attorney, moves this Honorable Court for leave to submit out of time the telephone calls the government intends to offer in its case in chief at the trial of the case, and also represents that the attached nine telephone calls will be part of its case-in-chief at trial: 1. The Court ordered the government to disclose the telephone calls it intends to submit as evidence to the Court and defense counsel by February 16, 2006. 2. The attached telephone transcripts were disclosed to the defense on February 24, 2006, and they represent telephone calls previously disclosed in discovery on this case. 3. The undersigned counsel was on annual leave between February 15 through February 20, 2006. Although the office received these transcripts from the case agent on February, 16, 2006, the undersigned counsel did not realize they were in relation to the court's previously set deadline for submission until February 24,

2006. Immediately, undersigned counsel faxed the calls to defense counsel, and herein seeks leave to submit them to this Honorable Court out of time. 4. The defense is not prejudiced by this out-of-time submission because the calls were previously disclosed, and because they were disclosed well in advance of the pretrial and trial settings.
