NOTICE OF SUPPLEMENTAL AUTHORITY TO PARTIAL RESPONSE TO MOTION FOR SUMMARY JUDGMENT AND REQUEST FOR CONTINUANCE PURSUANT TO RULE 56(f) Defendant Jamie Goldstein submits this Notice of Supplemental Authority to Partial Response to Motion for Summary Judgment and Request for Continuance Pursuant to Rule 56(f). As set forth in Mr. Goldstein's Partial Response to Motion for Summary Judgment and Request for Continuance Pursuant to Rule 56(f) (the "Response"), Plaintiffs' claims are subject to the defense of in pari delicto. (Response at 19-23). Attached hereto is a copy of Official Committee of Unsecured Creditors of PSA, Inc. v. Edwards, 437 F.3d 1145, (11th Cir. 2006), where the 11th Circuit Court of Appeals held the doctrine of in pari delicto bars claims alleged under the Racketeer Influenced and Corrupt Organizations Act ("Federal RICO"), 18 U.S.C. § 1962(a) and (d). Plaintiffs' first three claims for relief are RICO claims. (Complaint at ¶¶ 264-87).

Also attached hereto is a copy of Flatau v. Johnson (In re Stewart), 339 B.R. 524, 527 (Bankr. M.D. Ga. 2006), which held that the doctrine of in pari delicto bars claims alleged under Georgia's RICO statute, O.C.G.A. §§ 16-14-4 ­6, as that statute is similar to the Federal RICO statute. Florida's RICO statute, Fl. St. Ann. § 895.03 and .05 ("Florida RICO"), is also similar to the Federal RICO statute. Plaintiffs' fourth through sixth claims for relief are Florida RICO claims.
