HEARING: Final Trial Preparation Conference 8:18 a.m. Court in session.

M r. Garbo and client representative for the defendant, Jennifer M ayhew, present by telephone. Opening remarks by the Court. Oral findings and conclusions of law are made of record and incorporated herein. ORDER: First M otion for Extension of Time to August 4, 2005 (Doc. #138) is denied as moot.

Discussion regarding voir dire. Discussion regarding opening statements and closing arguments. Opening statements shall be 15 minutes and closing arguments shall be 30 minutes.

No objections by either party to juror notetaking. Both parties request the jurors be given a questionnaire after their service. Discussion regarding witness and exhibit lists. The Court recommends that the parties submit a list of stipulated facts. Discussion regarding jury instructions and charging conference. Plaintiff requests the trial be continued until November. Defendant objects to the trial being continued. The Court informs the parties that if the trial does not go forward in September, because of the second position setting, the Court will continue the trial to November 22, 2005. 8:59 a.m. Court in recess.
