Defendants hereby move to allow out-of-state counsel to appear via telephone at the Preliminary Pre-Trial Conference set for January 31, 2006 at 10:00 a.m. 1. A Preliminary Pre-Trial Conference is set before Magistrate Coan for January 31,

2006 at 10:00 a.m. All of the Defendants are represented by out-of-state counsel and would like to participate in the Preliminary Pre-Trial Conference by telephone. Local counsel for the Defendants may appear in person. 2. In the proposed Preliminary Pre-Trial Order, all parties agreed to waive the

Preliminary Pre-Trial Conference but Magistrate Coan has not vacated the conference. 3. Plaintiff's counsel does not object to the relief requested in this Motion.
