SECURITIES LITIGATION ______________________________________________________________________ UNOPPOSED MOTION FOR ENTRY OF STIPULATED [PROPOSED] ORDER EXTENDING DEADLINE FOR PRODUCTION OF LIMITED WAIVER DOCUMENTS ______________________________________________________________________ Qwest Communications International Inc. ("Qwest") respectfully requests that this Court enter the Stipulated [Proposed] Order Extending Production Deadline that is attached as Exhibit 1 to this motion. As good grounds therefore, Qwest states as follows: 1. This Court previously ordered Qwest to produce certain documents

subject to Qwest's claim of privilege. See February 2, 2006 Order Concerning Qwest's Renewed Motion to Reconsider & To Certify Interlocutory Appeal (Docket # 923) ("February 2, 2006 Order"). 2. This Court subsequently stayed Qwest's production obligations under the

February 2, 2006 Order pending resolution of Qwest's petition for writ of mandamus filed with the United States Court of Appeals for the Tenth Circuit ("Mandamus Petition"). See March 10, 2006 Order Staying Production Of Documents (Docket # 950) ("March 10, 2006 Order").

On June 19, 2006, the Tenth Circuit denied Qwest's Mandamus Petition.

See In re Qwest Communications International Inc. Securities Litigation (App. No. 061070 June 19, 2006) ("Mandamus Decision").1 4. This Court subsequently stayed Qwest's production obligations under the

February 2, 2006 Order and the March 10, 2006 Order pending resolution of Qwest's petition for writ of certiorari filed with the United States Supreme Court. See September 28, 2006 Order Staying Production Of Documents (Docket # 1052) ("September 28, 2006 Order"). 5. Pursuant to its September 28, 2006 Order, the stay shall be lifted "ten

days after the United States Supreme Court either denies Qwest's Petition for Writ of Certiorari, or rules on Qwest's claims after granting Qwest's Petition for Writ of Certiorari." September 28, 2006 Order, at 3. 6. On November 13, 2006, the Supreme Court denied Qwest's Petition for

Writ of Certiorari. See Qwest Communications International Inc., Petitioner, v. New England Health Care Employees Pension Fund, et al., No. 06-343 (Docket entry dated Nov. 13, 2006). 7. The parties have agreed to extend the deadline for Qwest's production

obligations under this Court's September 28, 2006 Order to February 15, 2007.2 Qwest

requires this additional time in order to prepare the documents for production, particularly in light of this Court's February 2, 2006 Order that permits Qwest to redact opinion work product from the more than 220,000 pages it must now produce. 8. Pursuant to D.C.COLO.LCivR. 6.1(A), "[n]o stipulation by the parties can

affect a date or deadline established by court order," and pursuant to D.C.COLO.LCivR. 6.1(B), "[e]xcept as provided in section A. of this rule, all requests for extensions of time must be approved by court order upon motion." WHEREFORE, Qwest respectfully requests that this Court enter the Stipulated [Proposed] Order Extending Production Deadline attached hereto as Exhibit 1.
