The parties submit the following Status Report pursuant to the Court's February 7, 2005 Amended Minute Order requiring the parties to "file a status report advising the Court as to what depositions have been completed; what depositions have been scheduled but not yet completed; and what depositions are anticipated but not yet scheduled." Lead Plaintiffs also request that the Court schedule a status conference to discuss the issues raised below at the Court's convenience. Defendants do not oppose this request. Under the Order Providing for Coordinated Discovery with Parallel Qwest Litigation, Lead Plaintiffs in the Federal Class Securities Litigation may take up to 80 Common Qwest Depositions, and all defendants may take up to 80 Common Qwest Depositions. As of July 15, 2005, the parties have taken 36 depositions ­ 30 Common Qwest Depositions noticed by Lead Plaintiffs and six relating to the Federal Class Securities Litigation noticed by defendants (see Attachment A). Lead Plaintiffs have also noticed, but have not yet taken, 19 additional Common Qwest Depositions (see Attachment B). Lead Plaintiffs are also attempting to schedule nine, and defendant Andersen is still considering 12, more Common Qwest Depositions (see Attachment C). Further, Lead Plaintiffs are negotiating with Qwest and Arthur Andersen over the necessity of further 30(b)(6) depositions but at this time believe none are necessary. Beyond these depositions, at the request of the United States Attorney for the District of Colorado, Lead Plaintiffs have deferred 15 scheduled depositions, including three defendants in this action: Robin Szeliga, James A. Smith and Drake Tempest (see Attachment D). -1-

Lead Plaintiffs are informed that the United States Attorney will make an appearance in this action and seek an order from the Court providing that these depositions be further postponed. Additionally, plaintiffs in the State Coordinated Qwest Actions have taken one deposition and have currently noticed six others. Defendants have also taken a number of depositions of plaintiffs in the State Coordinated Qwest Actions and their related entities. Lead Plaintiffs also wish to raise the following issues: 1. Substitute Depositions

Lead Plaintiffs have identified seven additional deponents not listed on their January 14, 2005 deposition list. Lead Plaintiffs believe depositions of these witnesses are relevant to the action, and will ask the Court to allow them to substitute these deponents for proposed deponents previously identified on their list. Provided that depositions of these witnesses proceed in lieu of witnesses identified on Lead Plaintiffs' January 14, 2005 deposition list and the 80 witness limit established by this Court is not exceeded, defendants do not object to Lead Plaintiffs' proposed substitutions with respect to the witnesses numbered 1-4 and 6-7 above. With respect to

witness number 5, Richard Petersen, defendant Andersen currently is assessing witness availability and willingness to consent to Lead Plaintiffs' proposed substitution. 2. Depositions Regarding Issues that Are the Subject of Pending Motions

On May 31, 2005, Magistrate Judge Shaffer ordered Qwest to produce certain documents previously produced to the government but withheld from Lead Plaintiffs based on Qwest's assertion of privilege. Qwest has appealed Magistrate Judge Shaffer's May 31, 2005 Order to Judge Blackburn, and has sought to stay production of the documents pending that review. Further, there are various motions and appeals regarding the proper pleading and production of information surrounding the "advice of counsel" defense. Lead Plaintiffs have not yet seen the documents at issue in the various motions, but likely will seek to take depositions of individuals revealed to be relevant to the issues. As Lead Plaintiffs have not had access to the documents, they have no way of knowing the extent of relevant witnesses or deponents. Defendants reserve the right to object to any depositions to the extent such depositions occur after the deposition deadline or otherwise exceed the limits this Court has imposed on deposition discovery, and defendants further reserve the right to object to the reopening of any previously conducted deposition. * * *

Defendants Joseph Nacchio and Robert Woodruff, whose depositions are currently scheduled for mid-September, believe that as a result of the adjournment of the depositions listed in Attachment D, fact discovery cannot be completed by the current deadline. These -3-

adjournments, moreover, will continue to adversely and unfairly affect Nacchio's and Woodruff's defense of this matter, and they request that the Court address this issue at the status conference proposed by Lead Plaintiffs. Nacchio and Woodruff also respectfully reserve their rights to respond to any motion by the United States Attorney seeking further postponement of any depositions until such time as the United States Attorney may seek to intervene in this proceeding. Defendant Arthur Andersen LLP is also concerned that as a result of the adjournment of the depositions listed in Attachment D, fact discovery cannot be completed by the current deadline without adversely affecting its ability and rights to defend itself in this matter.
