ABP and the Citigroup Defendants stipulate and agree as follows: WHEREAS, on July 15, 2005, ABP and the Citigroup Defendants entered into a stipulation resolving Plantiff's motion on July 1, 2005 titled Plaintiff's Motion to Have the Deposition of Jack Grubman Taken In The WorldCom Litigation Deemed Produced (the "Deposition Motion"). WHEREAS, in reliance on that stipulation, the Court entered an order on July 19, 2005 denying the Deposition Motion as moot.

WHEREAS, after further discussions between counsel for ABP and counsel for the Citigroup Defendants, and in the interests of judicial economy and to avoid the costs and burdens associated with litigating the dispute, the parties agree that the motion entered at docket # 728 for leave to file the memorandum of law in support of the Deposition Motion under seal should be withdrawn as moot. NOW, IT IS THEREFORE STIPULATED, AGREED, and ORDERED as follows: Plaintiff's Motion [D.E. # 728] filed July 1, 2005 for leave to file the memorandum of law in support of the Deposition Motion under seal is withdrawn as moot.
