The parties, including Intervenor Plaintiff the United States Attorney's Office ("USAO") for the District of Colorado, submit the following Joint Status Report regarding depositions pursuant to the Court's instructions at the August 17, 2005 Status Conference. The Court requested a list of all depositions that will proceed pursuant to its instructions at the Status Conference. The parties report as follows: As noted at the Status Conference, there are 18 depositions Lead Plaintiffs seek to take that, as of August 17, 2005, the USAO had not sought to embargo. All of them will proceed, with the conditions as noted below. Eleven of the depositions were previously noted or scheduled, and were not mentioned in the motion to stay filed by the USAO. The remaining seven were listed in the Joint Status Report filed by the parties on July 15, 2005 and the parties are to report whether the USAO seeks to add these depositions to its list of embargoed witnesses. Under the current Scheduling Order dated January 27, 2005, depositions are set to conclude on September 16, 2005. The automatic stay of deposition discovery invoked by Qwest Communications, Inc. ("Qwest") in its protective order motion lasted from August 4, 2005, when the motion was filed, until August 17, 2005, when the Court lifted it. Given this two-week stay, Lead Plaintiffs ask that the deposition discovery deadline be extended to September 30, 2005, with the exception of Richard Petersen, who is not available until October 6, 2005.1 Arthur Andersen LLP ("Andersen") believes it would be more

economical, and reduce the number of deposition tracks, to extend the deadline to October 15, 2005. No other defendant objects to extending the deposition discovery deadline to either September 30 or October 15, 2005. Lead Plaintiffs believe that the September 30, 2005 deadline is sufficient at this time. Lead Plaintiffs are attempting to schedule or reschedule the relevant depositions before that date. With regard to the Anschutz Company 30(b)(6) deposition, the USAO does not object to the deposition proceeding so long as none of the witnesses offered to testify are individuals on their list of embargoed deponents (i.e., Philip Anschutz, Craig Slater and Cannon Harvey). With regard to Kevin Baird, among the documents that Qwest produced to the Government pursuant to its written confidentiality agreements are communications to and from Mr. Baird, formerly a lawyer at Qwest. To date, Qwest has not produced these documents to Lead Plaintiffs. Additionally, Qwest redacted portions of the investigatory testimony from Mr. Baird's examination before the United States Securities & Exchange Commission. Although, on August 15, 2005, Judge Blackburn affirmed Magistrate Judge Shaffer's order compelling Qwest to produce those documents it has withheld based on its claim of "limited waiver," Qwest has advised Lead Plaintiffs that it may seek further review of that order. As it would be inefficient to depose Mr. Baird twice, Lead Plaintiffs ask that that Mr. Baird's deposition be postponed until the SEC privilege waiver issue is finally resolved. All defendants agree.
