The Court's December 2, 2005 order requires all motions relating to discovery

and experts to be filed by May 1, 2006. 2. 3. Subsequently, the trial of this matter was postponed until November 13, 2005. The parties have agreed, subject to the Court's approval, that the motions deadline

should be extended to June 30, 2006. 4. Also pursuant to the Court's December 2, 2005 minute, the parties will contact

Magistrate Michael Hegarty within ten days to schedule a settlement conference in this matter. The parties have agreed to delay any settlement conference until after the May 13, 2006 deadline for appealing Judge Krieger's recent decision in the case of Sierra Club v. Cripple Creek & Victor Gold Mining Co., Civil Action No. 00-MK-2325-MEH (D. Colo.).
