JUDGMENT

PURSUANT to and in accordance with the Memorandum Opinion and Order entered by the Honorable Magistrate Judge Boyd N. Boland, on June 4, 2007, it is ORDERED that judgment is entered in favor of Defendant, (formerly known as El Paso Gold Mines, Inc.), and against Plaintiffs, Sierra Club and Mineral Policy Center. It is FURTHER ORDERED that the Complaint and this civil action are dismissed with prejudice. It is FURTHER ORDERED that Defendant, El Paso Properties, Inc., shall have its costs, to be taxed by the Clerk of the Court pursuant to Fed.R.Civ.P.54(d)(1) and D.C. COLO.L.CivR 54.1 upon the filing of a Bill of Costs with the Clerk of the Court within 10 days of entry of this judgment. DATED at Denver, Colorado, this 5th day of June, 2007.
